DMCA

HiParenting.com respects the intellectual property rights of others and expects its users to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). This page outlines how copyright owners can submit takedown requests and how affected users can respond.

1. Copyright Infringement Notification

If you believe that material located on or linked to by HiParenting.com infringes your copyright, you must submit a written notification (a “DMCA Notice”) that includes the following:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered;
  • Identification of the material that is claimed to be infringing or the subject of infringing activity, including information reasonably sufficient to allow us to locate the material;
  • Your contact information, including your full name, address, telephone number, and email address;
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

DMCA Notices should be sent to:

DMCA Agent
HiParenting.com
Email: dmca@hiparenting.com
Subject: DMCA Takedown Request

Upon receiving a proper notification, we will promptly remove or disable access to the allegedly infringing content and notify the user who posted it.

2. Counter Notification

If you believe that your material was removed or disabled by mistake or misidentification, you may send us a written counter-notification that includes:

  • Your physical or electronic signature;
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled;
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification;
  • Your name, address, telephone number, and email address;
  • A statement that you consent to the jurisdiction of the federal court located within your district (or if outside the U.S., that you consent to jurisdiction in any district in which HiParenting.com may be found), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.

Send your counter-notification to:

DMCA Agent
HiParenting.com
Email: dmca@hiparenting.com
Subject: DMCA Counter Notification

Upon receipt of a valid counter-notification, we may restore the removed content unless the original complainant files a court action seeking a restraining order against the content provider.

3. Repeat Infringers

HiParenting.com reserves the right to terminate the accounts of users who are repeat infringers of intellectual property rights, in appropriate circumstances and at our sole discretion.

4. Misrepresentation

Please be aware that under Section 512(f) of the DMCA, any person who knowingly misrepresents that material or activity is infringing may be subject to liability. Legal action may be taken in such cases.
